1. Definitions
- Client
- A individual or legal entity interested in purchasing a car at an auction through AUTASNAP.
- AUTASNAP
- LIENZO Sp. Z o.o., a company providing services in vehicle selection, purchase, delivery, and registration from US and European auctions.
- Auctions
- Electronic platforms for car sales (Copart, IAAI, ALD, Arval, etc.).
- Lot
- the specific vehicle listed for auction.
- Application
- The client's expressed intention to participate in the bidding on a specific lot, through the website or correspondence.
- Port of Arrival
- Selected port in the EU for vehicle pickup.
- Delivery Provider
- Third-party company responsible for transportation and customs clearance.
2. Subject of the agreement
AUTASNAP acts as an intermediary, representing the Client's interests at US and European auctions.
AUTASNAP offers the following services:
- Search and vehicle selection;
- participation in tenders;
- Issuing an invoice (in the case of Europe) or providing payment details (in the case of the USA);
- organization of delivery and customs clearance;
- Assistance until the vehicle is handed over to the client.
3. Payment Terms
3.1 USA
- Payment for the vehicle cost and auction fees is made by the Client independently using the auction's bank details, in US dollars (USD) via SWIFT transfer.
- Upon the vehicle's arrival at the EU port, the Client pays:
- shipping by sea (if not paid earlier);
- Customs clearance services.
3.2 Europe
AUTASNAP issues a single invoice that includes:
- Price of the car;
- delivery to the Customer's door;
- Excise and auction fees.
Payment is made to the Polish company's bank account in EUR or PLN.
4. Client Responsibilities
- agrees to independently familiarize themselves with the description and history of the vehicle before submitting the application;
- carries risks associated with purchasing damaged or technically faulty vehicles;
- agrees to make all payments within the specified timeframes (usually within 48 hours after winning the auction);
- agrees that winning the auction is a legally binding transaction and cannot be canceled.
5. AUTASNAP Responsibilities
- Act in good faith in the best interests of the Customer;
- Transfer the current billing details and payment accounts;
- Organize logistics if it is part of the service;
- Provide the Client with all documents: Title, invoice, CMR, declarations;
- Assist the client throughout all stages of the transaction.
6. Limitation of Liability
AUTASNAP is not responsible:
- for the technical condition of the vehicle;
- Denial of vehicle registration in the Client's country;
- for delays caused by third parties (auctions, carriers, customs);
- In case of loss or damage to the vehicle during transportation if insurance was not arranged.
7. Deposit
To participate in the auction, the Client deposits a refundable deposit, depending on the selected rate.
- The deposit is held until the transaction is completed.
- In case of refusal to pay after winning — the deposit is retained as a penalty.
8. Final Provisions
All transactions are governed by the laws of the Republic of Poland.
Both parties strive to settle any disputes through negotiations; if unable to do so, the dispute will be settled in the courts at the registered address of AUTASNAP.
